By accessing the Site you agree to these Terms. If you do not agree, do not use the Site.

1. Who these terms apply to

These Terms apply to all visitors, prospects, and users of the Site. Paid consulting engagements are governed by a separate written Statement of Work or Master Services Agreement, which, in case of conflict, prevails over these Terms.

You agree to use the Site only for lawful purposes and in a way that does not infringe the rights of others or restrict their use. You must not:

  • Attempt to gain unauthorized access to the Site, its servers, or related systems.
  • Probe, scan, or test vulnerabilities without authorization (see security.txt for coordinated disclosure).
  • Use automated means to scrape, copy, or harvest content except as expressly permitted by our robots.txt.
  • Transmit malware, spam, or other harmful material.
  • Misrepresent your identity or affiliation.

3. Intellectual property

The Site and all original content — including text, graphics, logos, trademarks, code, and design — are owned by Thinking Bytes or our licensors and are protected by copyright, trademark, and other laws. You may view the Site and share links to it. You may not reproduce, modify, redistribute, or create derivative works without our prior written permission, except for personal, non-commercial use or as permitted by law.

4. Content you submit

When you send us a message, inquiry, or any other content (“Submissions”), you grant us a worldwide, non-exclusive, royalty-free license to use the Submission to respond to you, deliver services, and improve our offerings. You represent that you have the right to share any Submission and that it does not infringe the rights of any third party.

5. Third-party links and services

The Site may link to third-party websites and embed third-party services (e.g., scheduling, analytics, social media). We are not responsible for the content, policies, or practices of those third parties. Your use of them is at your own risk and subject to their terms.

6. No professional advice

Content on the Site — including blog posts, case studies, and resources — is provided for informational purposes only and does not constitute legal, financial, tax, or other professional advice. You should not act or refrain from acting on the basis of Site content without seeking professional advice appropriate to your situation.

7. Disclaimers

THE SITE IS PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, OR AVAILABILITY. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

Nothing in these Terms limits or excludes liability that cannot be limited or excluded under applicable law, including for fraud, gross negligence, personal injury caused by negligence, or statutory consumer rights.

8. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THINKING BYTES AND ITS OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THE SITE IS LIMITED TO ONE HUNDRED U.S. DOLLARS (US$100). Consulting engagements have separate liability terms set out in the applicable Statement of Work.

9. Indemnification

You agree to indemnify and hold Thinking Bytes harmless from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of your use of the Site, your Submissions, or your breach of these Terms.

10. Privacy

Our Privacy Policy explains how we handle personal data. By using the Site you acknowledge that policy.

11. Changes

We may update these Terms from time to time. Material changes will be indicated by updating the “Last updated” date. Continued use of the Site after changes take effect constitutes acceptance of the revised Terms.

12. Termination

We may suspend or terminate your access to the Site at any time, without notice, for any reason, including breach of these Terms. Sections that by their nature should survive termination (including IP, disclaimers, limitation of liability, and governing law) will survive.

13. Governing law and disputes

These Terms are governed by the laws of the Commonwealth of Massachusetts, United States, without regard to its conflict-of-laws principles. The state and federal courts located in Suffolk County, Massachusetts have exclusive jurisdiction over any dispute arising out of or related to these Terms, subject to any mandatory consumer-protection venue rights you may have under the law of your country of residence.
